Terms of Service for Holiday.com eSIM Services

By agreeing to these Terms, you are also agreeing to the Privacy Policy. These Terms and the Privacy Policy (together, the "Agreement") constitute a legally binding agreement between you and Holiday.com, so please read them carefully. If you are a resident of the United States, please carefully review the mandatory arbitration clause in Section 18 below.

1. Acceptance of Terms

By using and/or accessing the eSIM services provided by Holiday.com (the "Services"), you become a "Subscriber." As such, you ("you" or "Subscriber") are agreeing on behalf of yourself or those you represent to comply with and be legally bound by this Agreement, including being responsible for any charges arising from your use of the Services.

If you are accepting these Terms on behalf of your employer or another entity, you represent and warrant that: (i) you have full legal authority to bind your employer or such entity to the Agreement; (ii) you have read and understand the Agreement; and (iii) you agree to the Agreement on behalf of the party that you represent.

By creating an account, you represent that you are at least eighteen (18) years of age, or at least the age of majority in the jurisdiction where you reside, or that you are a valid legal entity, and that the registration information you have provided is accurate and complete. If you do not agree with any part of the Agreement, you may not use our Services.

2. Modifications to the Agreement

Holiday.com may update these Terms from time to time. Unless otherwise stated, each update comes into force as of the moment the amended Terms are published on the Site. If you continue to use the Services after these changes take effect, you agree to the revised Terms. Notification of material changes will be provided to Subscribers via an email message sent to the address you provided at sign-up. It is your obligation to review these Terms from time to time to stay informed of current rules and obligations.

3. Our Service: eSIM Data Plans

Holiday.com provides digital eSIM cards that enable cellular data connectivity on compatible devices. These plans are for data use only and do not include voice calling (telephony) or SMS (text messaging) services. You can use your eSIM for internet access, data-based apps (like WhatsApp, Skype, iMessage), and online activities while traveling internationally.

4. Device Compatibility

To use the Service, you must have an unlocked, eSIM-compatible device. A list of compatible devices is available on our website. The eSIM profile remains on your device even after your data plan expires, unless manually removed.

5. Account Registration

You must create an account on holiday.com or via the Holiday.com App to purchase and manage your data plans. You are solely responsible for keeping your Account information confidential and for all activity on your Account. If you suspect unauthorized access, inform us immediately.

6. Purchasing & Activation

After purchasing a plan, you will receive instructions to download and activate your eSIM. Activation requires a stable internet connection (Wi-Fi or cellular data). Each plan includes details on price, validity period, and supported countries. Plans are tied to the device they are installed on and cannot be transferred.

7. Pricing and Payment

Pricing is displayed at checkout. All fees are payable at the time of purchase. Taxes are included in the displayed price where applicable.

8. Cancellation, Refunds, and Money-Back Guarantee

  • Refunds: please visit our Refund Policy
  • Apple App Store Purchases: Subscribers who signed up via an in-app purchase through the Apple App Store are subject to Apple's refund policy. All refund requests for such purchases must be directed to Apple Support and are handled solely at their discretion.
  • Refund Processing: Refunds are generally processed within seven (7) days and are made to the original form of payment.
    • Non-Crypto Purchases: Refunds are sent in USD. For non-USD purchases, the refund amount may differ from the amount originally paid in local currency due to changes in foreign exchange rates or processing charges.
  • Unused Plans: You may also cancel an unused plan within 6 months of purchase and ask for a refund, subject to the conditions above.

9. Responsible Usage Policy (Fair Usage & Acceptable Use)

To ensure a consistent and reliable service for all customers, your use of the Services is subject to the following:

  • Fair Usage Policy: Unlimited data plans are subject to a Fair Usage Policy. While there are no strict data caps, customers who exceed 25GB of high-speed data usage within a 30-day billing cycle may experience reduced data speeds (throttling) during periods of network congestion. Throttled speeds are generally sufficient for basic browsing, messaging, and email. Continued or extreme data usage may be considered misuse and could result in plan restrictions or service suspension.
  • Acceptable Use: You agree not to misuse the Services. A misuse includes, but is not limited to:
    • Sending unsolicited advertisements (spam).
    • Transmitting any content that is illegal, hateful, threatening, or defamatory.
    • Infringing on the intellectual property rights of others.
    • Engaging in any form of hacking or unauthorized access to computing devices.
    • Using the Services for any unlawful purpose.
  • Consequences of Misuse: Holiday.com reserves the right to restrict access to the Services, terminate your Account, or take other legal measures, without providing a refund for Services already paid, if we believe at our absolute discretion that you have misused the Services.

10. License to Use the Services

Subject to your compliance with these Terms, Holiday.com grants you a worldwide, non-exclusive, non-sublicensable, revocable, and limited license to download and use the Services. Modifying, distributing to unauthorized parties, reverse engineering, or otherwise using the Services in any way not expressly authorized by Holiday.com is strictly prohibited.

11. Content, Language, and Social Interactions

Our content is originally written in English. Any translation is done on a best-effort basis, and we do not guarantee its accuracy. We may post content on social media or forums. You are solely responsible for any content you post on such channels. Holiday.com is not liable for content posted by Subscribers or third parties.

12. Third-Party Websites and Partner Services

The Services may provide links to third-party websites or partner services. Holiday.com is not responsible for the availability, content, or practices of these third parties. Your interactions with any partner services are governed by their own terms and policies, and you use them at your own risk.

13. Disclaimers and Changes to Services

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, HOLIDAY.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Service coverage, speeds, and quality may vary. We reserve the right to modify, suspend, or terminate the Services for any reason, at our sole discretion. We will attempt to notify users in advance of material changes.

14. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOLIDAY.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

15. Indemnification

You agree to indemnify, defend, and hold harmless Holiday.com, its officers, directors, employees, and agents from any claims and expenses, including attorneys' fees, arising out of your use of the Services or your violation of this Agreement.

16. Chargebacks

If you initiate a chargeback with your bank or credit card provider for any valid fees payable to Holiday.com, we reserve the right to immediately suspend your access to the Services. Initiating a chargeback is a breach of your payment obligations. We may delete your Account and restrict your future access if we believe the chargeback was requested in bad faith.

17. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, excluding its conflict of laws principles.

18. Dispute Resolution

  • For United States Residents:
    • Agreement to Arbitrate: Any dispute or claim between you and Holiday.com, including any disputes regarding whether a dispute or claim between the parties is arbitrable, shall be exclusively resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its rules. The fees and costs associated with arbitration will be those set forth in AAA applicable fee schedules. To learn more about the AAA Rules and how to begin an arbitration, you may call AAA at 800-778-7879, email AAA at CustomerService@adr.org, or visit AAA’s website at www.adr.org. If any claim or remedy is found by a court or arbitrator to be not arbitrable, that claim or remedy shall be severed and brought in court with the remaining claims and remedies arbitrated. Notwithstanding the above, you or Holiday.com may elect to litigate a claim in small claims court if the amount sought is within the jurisdictional limits of that court.
    • Class Action Waiver and Mass Arbitration Procedure: YOU AND HOLIDAY.COM MAY NOT BRING CLAIMS AGAINST THE OTHER AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

      If more than 25 arbitration demands of a substantially similar nature, are filed against us by the same law firm or collection of legal counsel or law firms, AAA shall (i) group the arbitration demands into batches of no more than 25 demands per group; and (ii) provide for resolution of each group or batch as a consolidated arbitration with one set of filing and administrative fees and a single arbitrator assigned per group or batch. To the extent AAA does not enforce these batching procedures, the parties agree that AAA shall endeavor to assign multiple proceedings to a single, mutually agreeable merits arbitrator consistent with the AAA Mass Arbitration Supplementary Rules.

    • Informal Resolution: Before arbitration, you agree to attempt to resolve the dispute informally for 60 days by sending a detailed notice to the following email address:

    • Opt-Out: You may opt out of this arbitration agreement within 30 days of your purchase or first use of the Service, whichever is sooner, by sending a written notice with the subject line "ARBITRATION AND CLASS ACTION WAIVER OPT-OUT" to the following email address:

  • For Non-U.S. Residents: Any dispute or claim arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Assignment

Holiday.com may assign this Agreement to a new corporate entity in the event of a merger or acquisition. You may not assign this Agreement without our prior written consent.

20. Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Holiday.com regarding the use of the Services and supersedes any prior agreements.
