1. Important Information About Our Role

This document outlines the terms and conditions of sale (the 'Conditions of Sale') for eSIM Data Plans provided by Telna ('eSIM Data Plans') purchased through the ExpressVPN app. It also includes other important details you need to be aware of.

We, Holiday.com, From the team behind ExpressVPN, ('Holiday.com'), market and facilitate the sale of eSIM Data Plans as an agent of TELNA Inc., a company registered in the Province of Ontario, whose registered office is at 20 Bay Street, 11th floor, Toronto, Ontario, Canada, M5J 2N8 ('Telna'). We also act on Telna's behalf to provide certain administrative support throughout the lifecycle of the eSIM Data Plans, including basic customer support.

Telna is the service provider of the eSIM Data Plans and by purchasing (including via redeeming free vouchers) an eSIM Data Plan, you are entering into an agreement with Telna, which can be accessed here ('Telna's Terms of Service'). Please read these carefully to familiarize yourself with the applicable terms and conditions before purchasing an eSIM Data Plan.

2. Holiday.com's eSIM: What's Included?

An eSIM (embedded SIM) is a digital SIM card downloaded onto your device. Holiday.com's eSIM is available only for data and it provides cellular data connectivity but does not offer voice services or a local phone number. It allows you to access the internet, use data-based apps, and perform online activities while roaming or in another country. However, you will not be able to make traditional voice calls or send SMS messages using the eSIM. You can use your eSIM for data roaming while continuing to use any existing SIM for voice.

With your eSIM, you can purchase eSIM Data Plans and connect your device to mobile networks worldwide without the need to switch to physical SIM cards.

3. Purchasing an eSIM Data Plan Through the ExpressVPN App

You can sign up for Services on our Website, Holiday.com, or through the Holiday.com App. To complete your registration, you must create an Account by providing certain required information (e.g., your name, email address, phone number, billing details, etc.). All information you provide must be complete, accurate, truthful, and kept up to date.

You are responsible for maintaining the confidentiality of your Account and password and for preventing access to your Account by any other individual. You agree to assume responsibility for and are solely accountable for any and all activities and usage that occur under your Account or password, including but not limited to use by any other person, whether authorized by you or not. To safeguard your Account, keep your password confidential and do not reuse it across other third-party services or subscriptions. You agree to promptly notify us of any unauthorized use of your Account or password.

Registration requires your agreement to our Terms, Privacy Policy, and to Telna's Terms and Privacy Policy, all of which are integral to these Terms and binding on all users of the Service

Before you purchase an eSIM from Holiday.com, please make sure that you have an unlocked, eSIM-compatible device. A list of compatible devices is provided here as a reference.

You do not need to download the Holiday.com App to use the product; you can purchase and redeem Data Plans through our Website. The downloaded eSIM will remain on the device even after the Data Plan expires or the credit is depleted or the account is deleted or your ExpressVPN subscription expires. While users may choose to remove the eSIM at any time, the eSIM must remain on the device for the Services to be provided, and should not be removed until the Data Plan has been fully depleted or expired.

4. Redeeming Vouchers From ExpressVPN

To redeem your ExpressVPN voucher, your Holiday.com email address must match the email address given when purchasing an ExpressVPN subscription. A phone number is also required at sign-up. Your Account is non-transferable and is to be used only by you. The voucher can only be redeemed by users who have not redeemed a voucher before.

Your voucher will grant you a certain amount of data that can be used for roaming services in specific countries. To find out more about the limitations of the countries please visit this page.

Your voucher cannot be used to purchase a larger plan than what your voucher offers.

You have until the end of your ExpressVPN subscription to redeem your voucher on Holiday.com. After redeeming, users have 30 days to activate and use their eSIM.

Example: I am a 1-year ExpressVPN user. I will receive a 1GB eSIM data pack via email, giving me until the end of my plan (1 year) to redeem the code on Holiday.com. On Holiday.com, I redeem the code for a 7-day 1GB Data Plan. Once I redeem the voucher, I have 30 days to activate the eSIM. However, once I arrive in the country of my choice, I only have 7 days to fully use the 1GB data allowance.

5. Downloading Your eSIM and Activating Your Data Plan

To activate Holiday.com's eSIM Data Plan(s), users must first download the eSIM and then activate the corresponding Data Plan. After purchasing an eSIM Data Plan, Telna will provide an eSIM for the device used to make the purchase. Both of these steps require a stable internet connection. Please note that charges will be applied upon the purchase of a Data Plan. For each new eSIM Data Plan, we will clearly state the price, data allowance, validity period, and included countries before your purchase. If you purchase multiple Data Plans for different countries or regions, you will need to download separate eSIMs onto your device. However, users who purchase top-up data for the same country, regional, or global plan, will be able to use the same eSIM.

Each eSIM Data Plan can only be installed once and must be used on the device it was installed on..

Once you purchase an eSIM Data Plan, we notify Telna, and Telna activates a corresponding Data Plan for your device's eSIM (except where the following paragraph applies).

If you have an existing eSIM Data Plan and purchase a new one for the same country/region, activation of your new plan will be delayed until the previous plan expires (when the validity period ends or data allowance runs out). For example, if you have an existing plan for Greece and purchase a new plan for Greece, your new Greek plan will activate only once your existing Greek plan expires.

Any additional Data Plans for other countries, will be available fr use once you visit the relevant country.

6. Using Your eSIM Data Plan

To ensure your eSIM functions correctly, you should configure your device settings as mentioned in Holiday.com website and app.

Any active eSIM Data Plan will connect automatically when you are in a country included in your plan and have network coverage. If you have multiple active plans, the most local plan will take priority (country first, then region, then global). For example, if you have both a plan for France and a European plan, and use data in France, your data will be taken from the French plan.

You can track your active eSIM Data Plans, connection status, and remaining data in your account within the Holiday.com Website or App.

Telna provides its service on an 'as is' and 'as available' basis. If we suspect fraud or misuse regarding your eSIM Data Plan, your access may be suspended. Telna may suspend your service in certain circumstances. Further information can be found in the Terms of Service.

7. Pricing

The pricing of eSIM Data Plans is variable. Live pricing can be viewed in the holiday.com app and Website. Pricing includes taxes and charges. The fee is payable at the time of purchase, even if the eSIM Data Plan is not activated until a later date.

8. Cancellation and Refunds

You can cancel an active but unused eSIM Data Plan within 14 days of purchase by contacting us through Support.

You may also request a refund for used eSim Data Plans for the unused service if a network or technical failure prevented Telna from providing the service.

9. Data Protection

Holiday.com and Telna are independent data controllers when processing personal data for the provision of eSIM Data Plans.

When you purchase an eSIM Data Plan via the Holiday.com App, we will share your email, phone, country of residence with Telna to calculate sales tax, as well as information about the Data Plan you have purchased. We may also share relevant customer support data with Telna if necessary.

If required, Telna may share additional identity verification data with law enforcement to meet legal obligations. Telna will be the independent controller of this data.

Holiday.com will process all personal data related to your use of the eSIM Data Plans in accordance with the Privacy Policy.

Please refer to the Terms of Service for information on Telna's Privacy Policy and how your personal data is handled by Telna.

10. Making a Complaint About Your eSIM Data Plan

You can raise any complaints or feedback related to your eSIM Data Plans via Holiday.com's customer support.

If the complaint pertains to Telna's services (such as availability or service disruptions), we may liaise with or forward your complaint to Telna for resolution, as it will be considered a complaint against them. ExpressVPN is not responsible for any disputes or claims between you and Telna.

11. Legal Matters

British Virgin Island Law Applies

The laws of the British Virgin Islands apply to these Conditions of Sale.

Taking Action Against Us

If you want to take legal action against Telna, please refer to the Terms of Service for your rights. ExpressVPN is not liable for any disputes or claims between you and Telna.

If you wish to bring a claim against us in court, the courts of the British Virgin Islands will have jurisdiction over any matters related to these Conditions of Sale.

Amendment to These Conditions of Sale

We reserve the right to amend these Conditions of Sale at any time. Changes will apply to eSIM Data Plans purchased after the date of amendment.
